Platform Edge Limited Warranty

This limited warranty is provided by iSwim2 Pty Ltd (iSwim2) to you as the purchaser of the Platform Edge swimming pool platform (Our Product) from iSwim2.

iSwim2 warrants that Our Product will be free from material defects in materials and workmanship from the date of original retail purchase of Our Product (Purchase Date) for the period of one (1) year from the Purchase Date (Warranty Period) subject to the following terms and conditions in this limited warranty document.

For consumers who are covered by consumer protection laws or regulations in their country of purchase or, if different, their country of residence, the benefits of this warranty are in addition to all rights and remedies conveyed by such consumer protection laws and regulations.

This limited warranty is governed by and construed under the laws of the country in which Our Product was purchased.

WHAT IS NOT COVERED IN THE WARRANTY

If, in iSwim2’s reasonable judgement:

  • Our Product has been subjected to abuse, accident, alteration, modification, tampering, negligence, misuse, faulty installation, lack of reasonable care, repair or service in any way that is not contemplated in the documentation for Our Product.

  • Malfunctions, or damage to Our Product not resulting from material defects in materials or workmanship.

  • Unauthorised repairs or modification during Warranty Period to Our Product.

  • Repairs undertaken by anyone other than an authorised iSwim2 repairer.

  • Operational adjustments to Our Product covered in the operating manual for the Our Product, and normal maintenance.

  • Rusting and tea-staining of 316 stainless steel components to Our Product.

  • Damage caused to Our Product by prolonged exposure to elements such as heat, water, sun, and hail.

  • Damage to Our Product that occurs in shipment, due to act of God, failures due to power surge, and cosmetic damage.

HOW TO MAKE A CLAIM

A claim must be made within Warranty Period.

We will assess the evidence with the professional help of our manufacturers and respond in a timely and reasonable matter.

Please email proof of purchase (clearly displaying the date of the original purchase) with photos and/or videos of the defect or damage to and a written description of the damage and what caused the damage (in your opinion) to lyn@iswim2.com.au.

DISCLAIMER FOR ALL OTHER WARRANTIES

EXCEPT FOR THE LIMITED WARRANTY SPECIFIED IN THIS DOCUMENT AND SUBJECT TO CONSUMER PROJECTION LAWS IN THE COUNTRY OF PURCHASE OF OUR PRODUCT, OUR PRODUCT IS PROVIDED “AS-IS” WITHOUT ANY WARRANTY OF ANY KIND WHATSOEVER INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

EXCEPT AS EXPRESSLY COVERED UNDER THE LIMITED WARRANTY PROVIDED IN THIS DOCUMENT, THE ENTIRE RISK AS TO THE QUALITY, SELECTION AND PERFORMANCE OF OUR PRODUCT IS WITH THE PURCHASER OF OUR PRODUCT.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, iSWIM2 IS NOT LIABLE UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY LOSS OF USE OF THE PRODUCT, INCONVENIENCE OR DAMAGES OF ANY CHARACTER, WHETHER DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, LOSS OF REVENUE OR PROFIT, OR ARISING OUT OF ANY BREACH OF THIS LIMITED WARRANTY,

EVEN iSWIM2 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SOLE REMEDY FOR A BREACH OF THE FOREGOING LIMITED WARRANTY IS REPAIR, REPLACEMENT OR REFUND OF THE DEFECTIVE OR NON-CONFORMING PRODUCT.

THE MAXIMUM LIABILITY OF iSWIM2 UNDER THIS LIMITED WARRANTY IS LIMITED TO THE PURCHASE PRICE OF OUR PRODUCT COVERED BY THE LIMITED WARRANTY.

GOVERNING LAW

This Limited Warranty shall be governed by the laws of the State of Queensland, Australia.
